Agreement to these terms
These Terms of Use (“Terms”) govern your access to and use of websites, portals, applications, and online services operated by BriteEducation School of Technology (“BriteEducation,” “we,” “us,” or “our”) including content served through domains such as school.britelink.io (the “Services”).
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Where you use the Services on behalf of an organisation (for example as staff), you represent that you have authority to bind that organisation.
These Terms protect both the institution and our community: they set clear rules for use of digital resources, protect intellectual property and operations, and affirm commitments to fair treatment, safety, and lawful handling of information consistent with our Privacy Policy.
Eligibility
The Services are intended for users who can lawfully enter into a binding agreement. If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement and consent of a parent or guardian where required by law. Certain areas (for example staff or registry tools) are restricted to authorised roles.
Description of services
BriteEducation provides educational programmes, student support, and related administrative and learning technology. Features may include programme information, applications, enrollment, fee payments, timetables, coursework, assessments, communications, and health or operational dashboards for permitted users.
We may modify, suspend, or discontinue features to improve quality, security, or compliance. We will endeavour to give reasonable notice for material changes that affect ongoing courses or access, except where urgent security or legal reasons require immediate action.
Accounts & security
You are responsible for maintaining the confidentiality of login credentials and for all activity under your account. You must notify us promptly of unauthorised use. We may use authentication providers and security measures (including multi-factor authentication) to protect accounts and institutional data.
Student protection: We implement access controls so that personal and academic information is available only to those with a legitimate educational or operational need, subject to our policies and applicable law.
Acceptable use
You agree not to misuse the Services. Without limitation, you must not:
- Violate any applicable law, regulation, or third-party rights;
- Harass, threaten, defame, or discriminate against others; post unlawful, hateful, or sexually exploitative content;
- Upload malware, probe or scan systems without authorisation, or attempt to bypass security or access controls;
- Scrape, data-mine, or use automated means to extract data at scale without our written consent;
- Impersonate any person or misrepresent affiliation with BriteEducation;
- Use institutional resources for unauthorised commercial solicitation or partisan political campaigning where restricted by law or policy;
- Share credentials or grant access to restricted areas to unauthorised persons.
We may investigate violations and cooperate with law enforcement. We may remove content or restrict access that violates these Terms or poses risk to the community.
Academic integrity & conduct
Students must follow academic honesty rules, assessment instructions, and codes of conduct published by BriteEducation. Cheating, plagiarism, impersonation, or misuse of generative AI where prohibited may result in academic penalties and account sanctions.
Fair process: Where disciplinary procedures apply, we aim to apply them consistently and proportionately, with reasonable opportunity for students to respond in line with our published policies and applicable law.
Fees, payments & refunds
Tuition and other fees are described in official fee schedules and enrollment materials. Payments may be processed by us or by payment partners. You authorise us and our processors to charge applicable amounts using the methods you provide, subject to successful authorisation.
Refunds & disputes: Refund eligibility, deadlines, and appeals are governed by the school's published financial policies and your enrollment agreement. If you believe a charge is erroneous, contact the finance office promptly with supporting details.
Intellectual property
The Services, including text, graphics, logos, course materials, software, and branding, are owned by BriteEducation or its licensors and protected by copyright, trademark, and other laws. Except for limited rights expressly granted, no licence is granted to you.
Students receive a limited, non-exclusive licence to access course materials for personal educational use during enrollment, not for redistribution, resale, or public performance outside permitted contexts.
Your content & licence
You retain rights in content you submit (“User Content”), subject to these Terms. You grant BriteEducation a worldwide, non-exclusive, royalty-free licence to host, use, reproduce, modify, display, and distribute User Content as needed to operate the Services, assess coursework, comply with law, and protect the community.
You represent that you have the rights to grant this licence and that your User Content does not infringe others' rights. We may remove content that violates law or these Terms.
Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRITEEDUCATION DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Educational outcomes depend on many factors; we do not guarantee employment, examination results, or accreditation outcomes beyond what is expressly stated in official programme documentation.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRITEEDUCATION AND ITS AFFILIATES, OFFICERS, STAFF, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) WHERE NO FEES APPLY, ONE HUNDRED UNITED STATES DOLLARS (US$100), EXCEPT WHERE LAW REQUIRES OTHERWISE (FOR EXAMPLE LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE WHERE SUCH LIMITATION IS PROHIBITED).
Balanced protections: Nothing in these Terms excludes or limits liability that cannot legally be excluded, or limits statutory rights that apply to consumers or students under mandatory law.
Indemnity
You will defend, indemnify, and hold harmless BriteEducation and its affiliates, directors, staff, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your misuse of the Services, your violation of these Terms, or your violation of third-party rights, except to the extent caused by our wilful misconduct or gross negligence.
Suspension & termination
We may suspend or terminate access to the Services where reasonably necessary for security, legal compliance, or breach of these Terms or institutional policies. Students remain subject to academic and financial obligations as set out in separate agreements.
Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive termination.
Privacy
Our collection and use of personal information is described in the Privacy Policy. By using the Services, you acknowledge that we process information as described there.
Governing law
These Terms are governed by the laws of the Republic of Zimbabwe, excluding conflict-of-law rules that would apply another jurisdiction's law, subject to mandatory protections that apply to you in your country of residence where they cannot be waived.
Disputes
You agree that courts located in Zimbabwe shall have exclusive jurisdiction over disputes arising from these Terms or the Services, except where mandatory law grants you the right to bring proceedings in your home jurisdiction.
Before filing a claim, you agree to contact us at team@britelink.io to seek an informal resolution.
Changes to terms
We may update these Terms from time to time. We will post the updated Terms on this page and revise the “Last updated” date. Continued use after notice constitutes acceptance, except where applicable law requires explicit consent for material changes.
